• The FedEx Promotional Offer (“Campaign”) is a campaign jointly organized by Federal Express (“FedEx”)  which shall be governed by the terms and conditions set out herein and/or by such terms as FedEx  shall impose from time to time. By participating in this Campaign, you will be deemed to accept these Terms and Conditions
• To be eligible to participate in this campaign, participants (“Participants”)
  a. Must not have an existing FedEx Business account
  b. Open a new FedEx Business account online during the campaign Period
• A Participant’s entry into this Campaign is confirmed by such Participant’s receipt of an email notification from FedEx confirming the opening of a new FedEx shipper account (the “Confirmation Notice”).
• A Participant who has successfully opened a FedEx account in accordance with Clauses 4 will be entitled to receive the following discounts and benefits
• A promotional discount (“Promotional Discount”) as follows (and as specified in the Confirmation Notice) off the list-priced basic freight charge of each Eligible Shipment (as defined below).The Promotional Discount does not apply to any other charges, such as duties and taxes, fuel surcharge, duty & tax surcharge or other surcharges:
      a)  Market / Type of FedEx Shipper Account  :-  India
      b)  Business/Corporate account     :- 67.5%

For the purposes of this Campaign, “Eligible Shipments” must meet all of the following requirements:

• Shipments must be invoiced to, and settled by, the FedEx shipper account specified in the Confirmation Notice in order to enjoy the Promotional Discount
• To be eligible for the Promotional Discount, shipments must meet the shipment criteria specified in the Confirmation Notice in order to be eligible
• Shipments must be tendered during the Campaign Period, as specified in the Confirmation NoticeShipments must be either FedEx International Priority Express (IPE), International Priority (IP); International Priority Freight (IPF), International Economy (IE), International Economy Freight (IEF), International Priority Letter (IP LTR) or International Priority Pack (IP PAK)

• The Promotional Discount cannot be used in conjunction with any other shipping discount or offer provided by FedEx.
• The Campaign may be subject to such other terms and conditions as may be imposed by FedEx and Participants agree to be bound by such terms.

General

• Each Participant hereby consents to FedEx, its parent and affiliates (collectively “FedEx” for the purposes of this clause), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the data disclosed hereunder (including across jurisdictions) for relationship management, marketing, advertising and promotion purposes. These purposes include any other purpose as authorized by such Participant, or as otherwise required or permitted by law. Each Participant also agrees that: (a) the consent herein overrides any earlier withdrawal of such Participant’s consent; (b) the consent herein does not supersede or replace any other consents which such Participant may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (c) FedEx, their authorized agents, service providers and/or business/marketing partners may contact such Participant via any mode and media about products and services offered by FedEx. • If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of this Campaign, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.
• In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Campaign, these Terms and Conditions will prevail.
• The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will control.
•  In the event of any discrepancies with respect to this Campaign, FedEx's decision is final and no other further correspondence will be accepted. FedEx will not be obliged to anything if it is contrary to any applicable laws or regulations.
• FedEx reserves the right to amend these Terms and Conditions at any time without notice.
• These Terms and Conditions shall be governed by the laws of India

• These offers (“Program”) are brought to you by Visa International (“Visa”) on a best effort basis
• Deutsche Bank AG, India (“Deutsche Bank”) and Visa shall not be responsible for, nor do they guarantee the quality of goods and services provided by any of the partner merchant establishments (“Partners”) in the Program, nor are they liable for any for any defect, deficiency, delay or imperfection in such goods / services or for any loss or damage that may be suffered, or for any personal injury to a cardholder directly or indirectly by use or non-use of the products / services provided by the Partners or by refusal by the Partners to honor the offer made under the Program
• The Program is open for participation to specified Deutsche Bank Visa Debit Cardholders (“Cardholders”), unless specified, who hold valid and current Visa Cards issued in India and who make the purchase from the Partners using these cards during the period specified by Partner. Details pertaining to the purchase and validity period of the offers are available in the individual offer details / terms and conditions of the Partners given above
• Cardholders must exercise due diligence in understanding specific terms that may be applicable to such offers
• Any participation / availing of the benefits by Cardholders shall be purely voluntary
• Any disputes regarding delivery, service, quality or performance of Partners in the Program must be addressed in writing by the customer directly to such Partners
• All offers are subject to additional and separate terms and conditions of the Partners. Cardholders can also ascertain the applicable terms and conditions by corresponding directly with the Partners
• Deutsche Bank and Visa reserve the absolute right and discretion to withdraw the Program or any offer made there under by any Partner or alter any of the terms and conditions of the Program at any time without prior notice
• These terms & conditions shall be read in conjunction with Deutsche Bank’s terms and conditions governing the usage of the debit card including the Cardholders Agreement
• Cardholders must specifically request the Partner for the offers under the Program. Cardholders can also make transactions with the Partner establishments without participating in the Program and availing the offers
• The offers made under the Program cannot be clubbed with any other offer / scheme or promotion that any of the Partners may extend to its customers. Third party purchase / bookings will not be entertained for any of the offers provided by the Partners
• Rates payable for goods and services purchased during the offer validity period are subject to service charges and applicable Government taxes
• Offers may be subject to other restriction by law
• Any dispute arising out of or in connection with this Program shall be subject to the exclusive jurisdiction of the courts in Mumbai only

• Offer details as shown are based on information provided by the Merchant. 
• No warranties are made by Visa that the information is correct. 
• Please check directly with Merchant to confirm the availability and validity of the Offer. 
• The Merchant is the sole provider of all goods and/or services under this offer. 
• Accordingly, the Visa Cardholder understands, acknowledges and agrees that the procurement by him/her of any goods and/or services under this Offer shall constitute a contract solely between the merchant and him/her, and Visa is not, nor will become, a party thereto. 
• By utilizing or attempting to utilize any of the goods and services under this Offer, the Visa Cardholder understands, acknowledges and agrees that: Any claim, complaint or dispute of any nature arising out of or in relation to the procurement, or attempted procurement by the cardholder of any goods and/or services under this offer (each a “Claim”) shall be settled by the Visa Cardholder directly with the Merchant, and Visa Cardholder shall not make any Claim against Visa.
